Our Terms

This website is owned and operated by Capstone Training Academy. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors online, physical and in – house employment training courses. It also offers physical tuition services and homeschooling to children between the ages of 8 and 18 years old in Loughborough. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

In order to use our website and/or receive our services, you must be at least 16 years of age or have an adult representing you as a parent/guardian, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you. If you are in the UK and between 16 – 18 years of age, to do any of our online or in-house courses you must be in full – time education, in an apprenticeship/traineeship or working/volunteering part – time for 20 hours or more. We may ask for evidence of this if you are under 18 years of age. For our tuition /coding services, booking and a physical meeting with parent/guardian is required for safeguarding purposes.

When purchasing a course, you agree that: (i) you are responsible for reading the full course details before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase a course when you commit to buy a course and you complete the check-out payment process.

The prices we charge for using our services / for our courses are listed on the website. We reserve the right to change our prices for courses displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page. For the children tuition services, these are priced currently at £20 per child per session with the possibility of discounts for any siblings. We prefer to take cash payments after each session for the tuition services but alternative payment methods can be discussed in the meeting. For the coding club, three payment plans are provided in which the annual and termly payments will be taken online and the weekly session will be decided by the customer how they would like to pay this. All the costs listed on this website are subject to change due to external factors to ensure running costs of the business are met.

“The fee for the services and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged on a monthly basis to your payment method.

Fulfilment Policy

At Capstone Training Academy, once you have selected and paid for a course from the bookable dates, a link will be sent to you to attend and/or online Zoom session. A trainer will be present to deliver the session and will allow for interaction over the call. At times, there is a possibility that there may be technical issues but your trainer will advise with regards to refunds or rescheduling session. This communication will be via email or phone. There will be opportunity at the end of each course session to you to directly communicate with the trainer and ask any questions. We expect that you behave responsibly and treat others with respect when in attendance online or offline at our sessions (see responsibility for services and products). For other services, communication will be through email e.g. CV checking or appointment based e.g. mock interview.

The same is the above for Capstone Tuition and Capstone Coding and in the unlikely event that a session needs to be cancelled, the parent/guardian will be notified by email or phone call. Holidays and centre closures will be outlined on the term time calendar that you will receive in the welcome pack when your child starts at Capstone Tuition and Capstone Coding.

Terms and Conditions: List

Refund Policy

For any course that does not run as scheduled (which has not been rescheduled) a full refund will be given. If you are unable to make the rescheduled time, then a full refund will be given.

If you have paid for the course but did not attend for any reason or cancel/reschedule the session (see cancellation policy), the course is non – refundable.

The above is also applicable to sessions in Capstone Tuition and Capstone Coding.

Cancellation Policy

If you wish to cancel or reschedule your course session, you must do so 48 hours before the start of the session to receive your full refund. Courses cannot be cancelled or rescheduled after this time and attendance will be expected.

The above is also applicable to sessions in Capstone Tuition.

For Capstone Coding the above is not applicable. If you wish to cancel a session in Capstone Coding and you have chosen a termly or annual plan, these are non - refundable. If you have chosen the weekly pay as you go plan, you do not need to pay for a session that was not attended by your child.

Retention of right to change offering

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

The above is also applicable to Capstone Tuition.

Responsibility for services and products

You are responsible for ensuring that you attend the session on time and ensure that you can connect to Zoom for the online sessions. You are required to have a browser and/or access to software in which you can open documents and pdfs that are shared in the online session (please see ownership of intellectual property, copyrights and logos on redistribution of our resources)

Parents/guardians are expected to bring and collect students on time to sessions and pay for the tuition services and coding club at the end of each session or in advance through the payment plan online. Staff at the centres will be responsible for the care of your child during the allocated session time and ensure that they follow all safeguarding procedures. In the event of an emergency, the emergency services will be contacted and any emergency contacts provided in the meeting will be contacted if you are unreachable.

Behaviour and Discipline Policy

Capstone Training Academy expects that all staff and fellow trainees on the course are treated with respect. You are expected to work co-operatively and treat all appropriately and in a fair manner. You should consider other people’s perspectives in discussion in order to help reach agreement.

 

Unacceptable behaviour (including bullying, harassment and victimisation) at Capstone Training Academy is not tolerated and any evidence of this will mean immediate removal from the course without a refund. If any criminal behaviour is suspected, authorities will be informed.

Students will be expected to behave responsibly with staff and other students. Inappropriate behaviour will not be tolerated and will be dealt with appropriately under safeguarding rules. You may be asked to remove and withdraw your child from the centre, depending on the disruption and severity of the behaviour.

Students who do disrupt other students learning whilst at the centre will be required to sit in isolation and parents/guardians will be informed when collected and given a warning. If the child receives a total of three warnings being at the centre, you will be asked to remove and withdraw your child from the centre.

Safeguarding Policy

At Capstone, we are committed to a duty of care, safeguarding and promoting the welfare of all our students. We have a thorough and comprehensive safeguarding procedure at Capstone. We will take any appropriate actions, such as informing the local authorities and designated safeguarding agencies within the Loughborough area, if we suspect any cases of a child in a vulnerable situation or discloses to be suffering from any form of abuse.

All staff at Capstone have undertaken safeguarding training and are DBS checked and any new members of staff that join at Capstone will undergo the same training and have an enhanced DBS check. 

Ownership of intellectual property, copyrights and logos

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Capstone Training Academy. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

You recognize and agree that by uploading any content (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works) through any means to the website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed at the website.

Photographs of children will not be taken without the consent of the parent/guardian in the initial meeting at Capstone Tuition. If a photo is taken with consent, it will only be used for marketing purposes only and on our social media. Faces may also be covered if you wish but please notify us if you wish to do this. If a consented image has been used on our marketing or social media and you wish for it to be removed, please notify us and we will aim to take down what is in our capacity swiftly.

Right to suspend or cancel user account

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment.

The above is also applicable to sessions in Capstone Tuition.

Indemnification

You agree to indemnify and hold [website owner] harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Capstone Training Academy, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, Capstone Training Academy assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

Right to change and modify Terms

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

Promotional emails and content

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time. 

Preference of law and dispute resolution

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of United Kingdom without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Leicester. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.
